Terms & Conditions Terms & Conditions Last Updated. 14th June 2008 1) Definitions In these terms and conditions of sale 'The Company' shall refer solely to M J Lewis Retail Registered office 29.Beeches Road Bayston Hill Shrewsbury Shropshire England SY3 0PG M J Lewis Retail acts as a direct retail outlet for the Awning Companion brand. ' The Purchaser' shall refer to an individual, individuals or businesses from whom orders are placed ' Goods' shall refer to any product or service offered by M J Lewis Retail, now or in future 2) General These terms provide the basis for which the company trades. And form part of a contract when entered into by the purchaser. These will form the basis of any agreement unless: special contractual conditions are arranged With the purchaser in writing. No variation of these terms will be given, unless accepted by the company in writing. 3) Prices and Charging Prices quoted are shown inclusive of VAT at the standard rate of 17.5%. The company reserves the right to amend this rate as determined by British Law. The company reserves the right to change this without prior notice. Extra payment will be required to facilitate postal charges, which are quoted for mainland UK deliveries. The appropriate charges are published on this web site. Customers can clearly see what they are likely to pay at point of sale. The company reserves the right to charge for carriage at the appropriate rate for special deliveries, or deliveries to offshore destinations, such as; Isles of Scilly. Isle of Man. Outer Hebrides. Northern Ireland. Islands of Orkney and Shetland. The company will notify the purchaser of the appropriate charges at point of ordering, or if not able to do so at that particular time. Make the necessary enquiries and notify the customer accordingly. 4) Payment The purchaser will not hold title of ownership of goods or services supplied by the company, or part thereof, until payment has been received in full. Goods will not be dispatched or services provided, until paid for in full. Unless by prior arrangement. Any alternative credit agreement, will only be offered by the company subject to written contract as agreed by the company unless a written contract is made between the company and the purchaser, the company reserves the right to use this document as a basis for any contract. Copies of these terms and conditions will be published as standard procedure on the company's website at www.awningcompanion.com 4) Payment continued Otherwise these terms and conditions are available to bona fide purchasers upon request. The company reserves the right to vary these terms and conditions as and when necessary and at the company's discretion. However if the purchaser is in contract with the company, the company will refer to the terms and conditions in force at the time of sale. Interest. The company reserves the right to charge interest for late payment of goods at 4% above the Bank of England base rate, which will be calculated at such time that an invoice falls overdue for payment. The company reserves the right to request pre-payment for all or part of the goods or services supplied at the company's discretion. 4a) Payment Methods The Company can accept payment by cheque, providing it has a card number written across the rear of the cheque. 5) Delivery The company reserves the right to allow 28 days for delivery from the time of order (This may be less) There may be times when availability of stock is in question, depending on seasonal demand, this may beyond our control. The company will take reasonable steps to ensure that goods are dispatched as soon as is practical. The company will do it's best to inform the customer accordingly if there is a foreseeable delay, or offer a refund ( see below), if goods are unable to be delivered in a suitable time frame. 5a) Refunds The company will offer the customer the option of a refund, if it is not possible to dispatch goods in a reasonable time The company informs purchasers making internet transactions that their goods have been dispatched by electronic mail Upon delivery, the purchaser assumes the risk for the goods, whether paid for or not. The purchaser must satisfy himself or herself that goods are received in good order upon receipt. The purchaser must notify the company as soon as possible and in any event not more than three working days, of any damage or shortfall arising from delivery or failed delivery. We will accept notice by telephone, e-mail or postal mail, outlining briefly what is wrong, so that we may make more detailed assessments of the problem. We prefer to be informed by e-mail if possible. The company reserves the right to use whichever carrier, courier or form of delivery it deems suitable for the purpose of delivery without consultation of the purchaser. The company reserves the right to dispatch large orders in more than a single delivery, if conditions dictate. The company will take reasonable steps to inform the purchaser accordingly. Loss or damage in transit. The company will replace goods lost or damaged in transit, providing: a) The company is notified of loss or damage, as soon as possible and in writing within five working days. The term (in writing) refers to postal mail or electronic mail via the Internet. b) Defective or damaged goods are withheld and preserved by the purchaser, for inspection by the company at the company's discretion, should the company so wish. Should the purchaser fail in these undertakings; the company may deem that goods have been delivered in accordance with contract. 6) Warranty The warranty as written below, applies to goods purchased directly from this site. We retain all the transaction details of purchases made from this website, so we can identify bona-fide purchasers The company warrants that it has title to offer goods for sale under its brand name Awning Companion The company offers a one-year guarantee from the date of sale. Proof of purchase is necessary. We retain all Pay pal transaction receipts for at least one year. The company may choose to market third party brands at it's discretion. The company maintains that the item or items for sale are of sufficient quality and suitable for their intended purpose. The company reserves the right to repair or replace faulty goods, as it deems suitable. The company will not consider claims, where an item has been abused or used for any purpose for which it was not technically intended. The company makes regular tests on its products to ensure that they are fit for their intended use. Instruction leaflets are supplied to facilitate the correct use and care of the goods. Awning Companion & Awning Handy Products The company explicitly authorizes use for the tension of caravan awnings only. The company does not test goods for any alternative use or purpose and offers no warranty in respect of any other use. The company will not be held liable for any damage occurring as a result of misuse of it's products or legal action brought about as a result of misuse of the products Return of faulty goods. The company may arrange return postage or reimburse the purchaser with the cost thereof, if goods supplied are not fit for their intended purpose. The company reserves the right to sell items from third party suppliers as deemed necessary. The company will uphold Any warranty offered by the original manufacturer/ retailer. The company will accept at its discretion returns, where goods have been purchased in error or the customer has changed their mind over their decision to purchase. Notice must be made to the company by telephone or electronic mail immediately. The company will only accept returns whereby the product is unused and in it's original packaging. The purchaser will be liable for the return carriage costs. 7) Intellectual Property Awning Companion and Awning Handy are the intellectual property and trademark of Baker & Lewis Leisure Products. M J Lewis Retail acts as an authorized distributor of the product, with the full endorsement of the manufacturer. Purchasing of any product bearing this name, does not allow the purchaser any rights to use the name Awning Companion or Awning Handy in connection with any other practice or activity. Baker & Lewis Leisure products is the sole manufacturer of the product sold and marketed as Awning Companion and Awning Handy. The company may actively pursue any person or businesses that uses these trademarks in any other way, or passes off third party goods with the same name. At the time of publishing, Baker & Lewis Leisure Products is the sole manufacturer of these products. Services. The services recommended by M J Lewis Retail on this web site are provided by the Utility Warehouse Discount Club for whom we act as an Independant and Authorised distributor. Baker & Lewis Leisure Products Leisure Products as a business has no connection with the Utility Warehouse Discount Club.
